Terms of Service

1. Introduction and Scope

These Terms of Service ("Terms") govern your use of Financero, a personal finance management application ("Service"), operated by OceanWeb Technologies s.r.o., a company incorporated in the Slovak Republic ("we", "us", "Company"). By creating an account or using the Service, you agree to these Terms in accordance with Regulation (EU) 2022/2065 (Digital Services Act) and applicable Slovak and EU law.

2. Service Description

Financero enables users to manually track personal income and expenses, manage multiple bank accounts, set saving goals, create budgets, and view financial statistics. The Service is a record-keeping tool and does not constitute financial advice, investment recommendation, or accounting service.

The Premium "Financial Health" (Financial Health) feature uses artificial intelligence to generate personalized financial insights and educational suggestions, including general information about investing concepts such as index funds. These AI-generated insights are for educational and informational purposes only. They do not constitute financial advice, investment advice, tax advice, or any professional recommendation. Past performance of any investment is not indicative of future results. All investments carry risk, including the potential loss of principal. You should consult a qualified financial advisor before making any investment decisions.

3. Eligibility

You must be at least 16 years of age to use the Service. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.

4. Account Registration and Security

To use the Service, you must register with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately at info@financero.io if you suspect unauthorized access.

5. Free and Premium Plans

5.1 Free Plan

The Free plan includes: unlimited transaction logging, up to 2 bank accounts, saving plans, budgets, statistics, and multi-currency support at no charge.

5.2 Premium Plan

The Premium plan costs 2.99 EUR per month and includes all Free features plus: unlimited bank accounts, recurring transactions, Financero Financial Analysis (AI-powered), Financial Health scoring, custom category management, and priority support.

5.3 Billing and Cancellation

Premium subscriptions are billed monthly via Stripe. You may cancel at any time through your account settings. Upon cancellation, you retain Premium access until the end of the current billing period. No refunds are issued for partial billing periods.

5.4 Right of Withdrawal

Under Directive 2011/83/EU, you have a 14-day right of withdrawal. By subscribing and using Premium features, you expressly consent to the immediate provision of digital content and acknowledge that you thereby waive your right of withdrawal once the service has been fully provided during the withdrawal period.

6. Acceptable Use

You agree not to: (a) attempt unauthorized access to the Service; (b) use the Service for any unlawful purpose; (c) interfere with or disrupt the Service; (d) upload malicious code; (e) impersonate another person; (f) use automated tools to access the Service without permission.

7. Intellectual Property

All rights, title, and interest in the Service belong to OceanWeb Technologies s.r.o. You retain ownership of the data you enter into the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages. The Service is provided "as is". Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be excluded under EU or Slovak law.

9. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted availability. We reserve the right to modify or discontinue any part of the Service with 30 days' notice for material changes.

10. Termination

You may delete your account at any time from Settings → Danger Zone. When you do so, your account is immediately deactivated, you are signed out, and you enter a 30-day grace period during which you may restore the account via a secure link sent to your email. On day 30, your data is permanently and irreversibly purged and any active Premium subscription is cancelled at that moment. No refunds are issued for the unused portion of the current billing period following voluntary deletion. We may suspend or terminate your account for violation of these Terms with prior notice, except in cases of serious or repeated violations. Upon termination, your data will be handled in accordance with our Privacy Policy.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Slovak Republic. As a consumer within the EU, you have the right to submit disputes to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to These Terms

We will notify you of material changes at least 30 days in advance via email or in-app notification. Continued use after the effective date constitutes acceptance.
